Thank you for using the YouFor2032 Talent Identification App (the YouFor2032 App). By accessing and/or using this YouFor2032 App and related services, you agree to these Terms and Conditions, which include our Privacy Policy (available at https://www.qld.gov.au/legal/privacy) (Terms). You should review our Privacy Policy and these Terms carefully and immediately cease using the YouFor2032 App if you do not agree to these Terms.

In these Terms'us', 'we' and 'our' means the Department of Tourism and Sport (Queensland Academy of Sport) (ABN 49 536 543 548);

‘you’ or ‘your’ means you the user of the YouFor2032 App.

‘Content’ means all features, information and material available on or through the YouFor2032 App.

Registration

You must ensure that all personal information that you enter into the YouFor2032 App is accurate and current. We will handle all personal information we collect in accordance with our Privacy Statement (YouFor2032 Privacy Statement) accessible on this app.

When you register and activate your account, you will provide us with a user name and password. You are responsible for keeping this user name and password secure and are responsible for all use and activity carried out through the YouFor2032 App under this user name.

Personal information

By providing your personal information to the QAS, you consent to the collection, use, storage and disclosure of that information as described in our Privacy Policy, these Terms and the YouFor2032 Privacy Statement.

The QAS is collecting your personal information to register you for, and facilitate your account with the YouFor2032 App. If you choose not to provide certain personal information, the QAS may not be able to process your registration or you may not be able to properly use the YouFor2032 App.

The YouFor2032 Privacy Statement and the Queensland Government Privacy Policy outlines how to access and/or correct your personal information or make a privacy related complaint.

The primary purpose for the collection of your personal information (if you are a prospective athlete) or your child’s personal information is to assist in the performance analysis of you or your child and to identify sport/s where you or they could excel in for the 2032 Olympic Games.

The purpose of collecting your personal information as a parent/guardian of your child is to verify that appropriate consent is given for or on behalf of the child to provide their personal information. We may use this personal information to contact you with further information regarding testing clinics or events.

The personal information and/or video footage may be disclosed to other Queensland government agencies, contracted service providers or sporting organisations which are involved in the training, performance analysis or coaching of the athletes. Unless authorised or required by law, your personal information will not otherwise be disclosed to any other third party without your consent. The QAS may disclose some or all of your personal information to various sports organisations, for the purpose of assessment of your potential talent for their sport based on your physical testing results. You should refer to each individual sport organisation’s privacy policy for further information about how they will handle your personal information.

By using this app, you have the option to opt into sharing your personal data with our trusted sponsors. If you choose to opt in, our sponsors may contact you with promotional offers, updates, or other communications. You can manage your data sharing preferences and opt out of receiving communications from sponsors at any time by accessing the settings within the app or contacting our support team. Please note that opting out will not affect your use of the app, but you will no longer receive communications from our sponsors.

You also have the option to opt out of sharing your personal information with YouFor2032 for research purposes aimed at improving our services and user experience. By default, your personal information that will assist in improving our services and user experience is shared for these purposes. If you prefer not to participate, you can opt out at any time by accessing the settings within the app or contacting our support team. If you change your mind, you can opt in again at any time using the same methods. Your decision to opt out or in will not affect your access to or use of the app's features.

If you provide us with personal information on behalf of another person, you warrant that you have the person’s consent to do so and that you have provided the person with these Terms and Conditions and our Privacy Policy.

General

By accessing the YouFor2032 App, you agree:

to use the YouFor2032 App only for the purposes of assessment of athlete suitability to join the YouFor2032 program;
to keep your user name and password confidential and not to disclose them to anyone except an authorised person;
to notify us immediately if you believe that the security of your user name or password have been compromised or if your profile has been accessed by an unauthorised person;
you will be given the ability to review, modify and update information relating to your personal information and you have an obligation to tell us if any of your contact or personal details change;
that we will only act on completed communications, that is, data “saved”. The display of a confirmation notice on-screen is evidence that your update has been received. We will not be liable for any loss or delay resulting from the non-receipt of any communication;
to use information that you obtain on the YouFor2032 App only for lawful purposes;
that any notifications regarding the YouFor2032 App that are provided to you or posted on the YouFor2032 App from time to time, form part of these Terms;
that we may amend these Terms at any time by posting an amended version on the YouFor2032 App. We may require you to accept any amended terms and conditions in order to continue to use the YouFor2032 App;
that we may withdraw or restrict your access at any time; and
that we will take all reasonable steps to ensure that the information which you access by using the YouFor2032 App is accurate and up-to-date.
That participating in the YouFor2032 App does not guarantee access to or placement with the QAS or affiliated sporting partners
That QAS may not contact you about your test results.

If you are an athlete, parent or guardian accessing the YouFor2032 App you agree:

to only access the YouFor2032 App in accordance with your legal obligations, including your obligations under the Privacy Act 1988 (Cth); and
that we will collect and handle your personal information in accordance with clause 2 above.

Accuracy, completeness and timeliness of information

While we use all reasonable attempts to ensure the accuracy and completeness of the information on the YouFor2032 App, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on the YouFor2032 App. You should monitor any changes to the information contained on the YouFor2032 App.

We are not liable to you or anyone else if interference with or damage to your computer or device occurs in connection with the use of the YouFor2032 App or a linked website. You must take your own precautions to ensure that whatever you select for your use of the YouFor2032 App is free of viruses or anything else (such as worms or Trojan horses) that may interfere with or damage the operations of your computer, your device or the YouFor2032 App.

We are not liable for breakages to your mobile device whilst using the YouFor2032 App.

We may, from time to time and without notice, change or add to the YouFor2032 App (including these Terms) or the information, products or services described in it. However, we do not undertake to keep the YouFor2032 App updated. We are not liable to you or anyone else if errors occur in the information on the YouFor2032 App or if that information is not up-to-date.

The YouFor2032 App may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.

Intellectual property rights

Your use of the YouFor2032 App and use of and access to any Content does not grant or transfer any rights, title or interest to you in relation to the YouFor2032 App, the Content or the Queensland Academy of Sport Wordmark. However, you are permitted to access the YouFor2032 App and view the Content in accordance with these Terms.

Information made available through the YouFor2032 App is confidential in nature (unless advised otherwise or it is already in the public domain) and must not be disclosed to a third party without our prior written consent.

Any reproduction or redistribution of the YouFor2032 App or the Content is prohibited and may result in civil and criminal penalties. In addition, any copying of the Content to any other server, location or support for publication, reproduction or distribution is expressly prohibited.

All other use, copying or reproduction of the YouFor2032 App, the Content or any part of it is prohibited, except to the extent permitted by law. However, you are permitted to make one copy for the purpose of viewing the Content for your personal use.

Reverse engineering and modifications

The YouFor2032 App is for your personal use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell the YouFor2032 App or any Content, software, products or services contained within the YouFor2032 App.

You may not reverse assemble or reverse compile or directly or indirectly allow or cause a third party to reverse assemble or reverse compile the whole or any part of the YouFor2032 App.

Unacceptable activity

You must not do any act in relation to the YouFor2032 App that we would deem to be inappropriate, is unlawful or is prohibited by any laws applicable to the YouFor2032 App, including but not limited to:

any act that would constitute a breach of either the privacy rights (including uploading private or personal information without an individual's consent) or other legal rights of individuals.
using the YouFor2032 App to defame us or partner sports organisations, our employees or other individuals.
uploading files that contain viruses that may cause damage to our property, the YouFor2032 App or the property of other individuals.
posting or transmitting to the YouFor2032 App any non-authorised material including, but not limited to, material that is, in our opinion, likely to cause annoyance, or which is false, defamatory, racist, obscene, threatening, pornographic or otherwise or which is detrimental to or in violation of our YouFor2032 App or network security.

Warranties and disclaimers

To the maximum extent permitted by law, including the Australian Consumer Law, we make no warranties or representations about the YouFor2032 App or the Content, including but not limited to warranties or representations that they will be complete, accurate, suitable, available or up-to-date, that access will be uninterrupted or error-free or free from viruses or other contamination, or that the YouFor2032 App will be secure, and that you should rely on the Content..

We reserve the right to restrict, suspend or terminate without notice your access to the YouFor2032 App or any Content, or any feature of the YouFor2032 App at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result.

Liability

To the maximum extent permitted by law, including the Australian Consumer Law, in no event shall we be liable (including without limitation, liable in negligence) for any expenses, losses, damages and costs you or any other person might incur for any reason you in connection with your use of the YouFor2032 App and/or the Content contained on it, or as a result of the inaccessibility, unavailability, unsuitability, inaccuracy, incompleteness, or lack of currency of the YouFor2032 App and the Content.

Jurisdiction and governing law

Your use of the YouFor2032 App and these Terms are governed by the law of Queensland and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Queensland.
